E-gift cards
Napoleon Perdis e-gift cards are redeemable online at napoleonperdis.com. They cannot be redeemed at department stores, Napoleon Perdis stockist locations or any other third-party outlets. Treat e-gift cards like cash. Subject to your Consumer Law Rights and to the maximum extent permitted by law, lost or stolen e-gift cards will not be replaced or refunded. This e-gift card cannot be exchanged for cash or refund. No change will be given but the balance may be applied to future purchases. It is the customer’s responsibility to provide a valid and correct email address at time of purchase, to which a copy of the e-gift card will be delivered. E-gift cards sent or forwarded to an incorrect email address may not be recoverable and, if used, cannot be resent or refunded. E-gift cards and their value expire 3 years from the date of issue. Applicable law
This site is created and controlled by Napoleon Perdis in the state of New South Wales, Australia. As such, the laws of the Commonwealth of Australia and, where applicable, the state of New South Wales, will govern these terms and conditions. By using this site you submit to the jurisdiction of the courts of New South Wales and Australia and agree that any legal action will only be commenced in these forums.
Napoleon Perdis may from time to time modify its terms and conditions, policies, or the content of the site, without notice. Eligibility
In order to make purchases through this site, you will be requested to provide your personal details. In particular, customers must provide their real name, phone number, email address and other requested information as indicated. Furthermore, when ordering items, you will be required to provide payment details. By entering your payment details you represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the billing information provided. The site is available only to individuals who meet the Napoleon Perdis terms of eligibility. Individuals must have been issued a valid credit card by a bank acceptable to Napoleon Perdis, applications must be acceptable to Napoleon Perdis and who have authorised Napoleon Perdis to process a charge or charges on their credit card in the amount of the total purchase price for the merchandise.
Napoleon Perdis reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.
By making an offer to purchase merchandise, you expressly authorise us to perform credit checks and, where Napoleon Perdis feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time, including but not limited to your credit-card number, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions. We reserve the right to only accept orders from those over the ages of 18, or 21 as legislated by the customer’s state of residence.
Products
We strive to ensure that product descriptions, specifications, prices, and images on our website are accurate. However, we do not warrant that product descriptions or other content is error-free, complete, or current. In the event of an error, we reserve the right to correct it and will notify you if this affects your order. Colours and images displayed on our website may vary from the actual product due to monitor settings, lighting, and photography.
Payment
You must pay in full when you place your order. The amount payable includes product price, delivery charges, and GST, as displayed at checkout. You remain liable for any import duties or other charges imposed by customs or tax authorities. We are not responsible for any delays or additional costs resulting from customs clearance processes.
We accept the payment methods displayed on our website at the time of purchase. Where we offer payment through third-party providers, your use of those payment methods may be governed by the third-party provider's separate terms and conditions, which you must review and accept directly with them.
Pricing Policy
Prices shown on napoleonperdis.com are in Australian dollars (AUD) and are inclusive of Australian goods and services tax (GST) where shown. GST is applicable to any Australian orders and is determined by the customer's ship-to address. Prices are subject to change.
Acceptance of your order
Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is not an acceptance of your order, just a confirmation that Napoleon Perdis has received it.
Unless you cancel your order, acceptance of your order and completion of the contract between you and Napoleon Perdis will be completed when Napoleon Perdis emails you to confirm the goods have been dispatched and have been handed over to the designated carrier. The sale contract is therefore concluded in New South Wales, Australia. Napoleon Perdis reserves the right to not accept an order in the event that: payment authorisation is unobtainable, if any item ordered is out of stock or that you do not meet the eligibility criteria set out within the terms and conditions.
Napoleon Perdis reserves the right to refuse service to anyone at any time at its sole discretion.
Intended use
By placing an order with Napoleon Perdis you agree to use the products only for their intended purpose. If you use the products for any other purpose you will assume full responsibility for any loss or damage arising out of this use.
Subscription Services
We provide subscription services, including our Golden Ritual subscription. By subscribing, you agree to receive our ongoing subscription service according to your subscription details shown in your account. We will supply the products in accordance with these Terms. You must be at least 18 years old to subscribe (or you must have the consent of your legal guardian).
Managing your Golden Ritual Subscription
If applicable, you may change your Golden Ritual subscription (such as your subscription tier) through your account before the next billing date.
We may change what is included in your Golden Ritual subscription with at least 14 days’ notice. If changes negatively affect your subscription, you may cancel when the changes take effect. You will receive a pro-rata refund if you’ve paid in advance.
All products are subject to availability. We may substitute similar alternatives due to market conditions beyond our control.
Golden Ritual Subscription Payments
You pay Golden Ritual subscription fees in advance according to the billing cycle shown on our website from the date you subscribe. Your Golden Ritual subscription automatically renews each billing cycle and you authorise us to charge you on each payment date, unless you cancel before the next payment date. We will notify you of your upcoming payment date at least 7 days before it falls due.
We may change the Golden Ritual subscription fees with at least 14 days’ notice, applying to future billing cycles. If you disagree with the new fees, you may cancel your subscription.
We accept the payment methods displayed on our website at the time of purchase. Where we offer payment through third-party providers, your use of those payment methods may be governed by the third-party provider’s separate terms and conditions, which you must review and accept directly with them.
Your Golden Ritual Subscription Cancellations
We may suspend or cancel Your Golden Ritual subscription due to circumstances beyond our control, such as product unavailability. We will notify you promptly and will not charge for unfulfilled orders. If we cancel for reasons other than your breach and you have paid in advance, you will receive a pro-rata refund.
You may cancel Your Golden Ritual subscription at any time by emailing experience@napoleonperdis.com. Cancellation takes effect at the end of your current billing cycle. If you do not cancel before the end of the current billing cycle and before your next billing date, you will be charged the subsequent subscription fee for the next billing cycle.
Either party may terminate immediately with written notice if the other party materially breaches these Terms.
We may suspend your access while investigating suspected breaches of these Terms.
Upon termination: (a) your account access will be removed, (b) if we terminate due to your breach, you must pay our reasonable additional costs including recovery fees, and (c) if we breach these Terms, we will refund any prepaid unused portion on a pro-rata basis.
Delivery, Title and Risk
We will supply the products in accordance with these Terms. We deliver to areas specified on our website. If you are outside our delivery area, please contact us to discuss alternative options. For one-off orders, any delivery timeframes shown on our website are estimates only.
We use various delivery methods. Some deliveries require a signature, while others may be left in a safe place or at your nearest post office for collection, subject to your preferences and our delivery partner’s policies.
We retain title to the products until we receive payment of the full purchase price. Until title passes to you, you must not create, permit or allow any encumbrance, security interest, charge, lien or other third-party interest over the products.
Risk in the products will pass to you when the products have been delivered to the delivery address, except where you have arranged for delivery by a carrier (not named as an option by us) yourself, in which case, risk in the products will pass to you on delivery to the carrier.
Returns and Refunds
We do not accept returns for change of mind. However, you may have rights to a repair, replacement or refund under the Australian Consumer Law (see below).
Australian Consumer Law
Nothing in these Terms attempts to modify or exclude the conditions, warranties and undertakings, and other legal rights, under the Australian Consumer Law (Consumer Law Rights). Any and all other warranties or conditions which are not guaranteed by the Australian Consumer Law are expressly excluded where permitted, except to the extent such warranties and conditions are fully expressed in these Terms.
Where you return products to us to seek an Australian Consumer Law remedy, you will need to cover any associated costs (for example delivery costs) of you returning the products to us.
Where your claim is a valid claim under the Australian Consumer Law, we will refund your return delivery costs and depending on the failure, either dispatch a new or repaired replacement product or refund you the price of the relevant product. Please contact us for further information.
Promotional Offers
Napoleon Perdis may, from time to time and at its sole discretion, offer promotional codes, discounts or other promotional offers. Promotional codes are personal to the customer to whom they are issued and are non-transferable. You acknowledge and agree that promotional codes cannot be redeemed for cash or credit, applied to previous purchases, or used in conjunction with any other offer unless expressly stated. There is a limit of one promotional code per customer per transaction.
Some promotional offers or discounts may be subject to additional terms and conditions. Where this is the case, those terms will be published on our website and by participating in the promotion, you agree to be bound by them in addition to these Terms.
Liability
Despite anything to the contrary, but subject to your Consumer Law Rights, to the maximum extent permitted by law:
(a) neither party will be liable for indirect, consequential, or special losses or loss of profits, revenue, or business opportunities;

All intellectual property rights in our website, products, trademarks, designs, graphics, logo and all materials are owned by Napoleon Perdis, or in some cases, a third party. These intellectual property rights are protected by Australian and international laws.
Your use of the site and its content grants no rights to you in relation to any copyright, designs, trademarks or any other intellectual property or material rights relating to its content (as described in the content section below).
You are permitted to use the content only as expressly authorised by Napoleon Perdis, its third party licensors and subject to the Copyright Act 1968 (Cth Australia) and other related legislation.
